Judge Lucy Koh recently denied Apple's most recent request to ban sales of Samsung's Galaxy Tab 10.1 in the United States. Koh rejected the request and and said she doesn't have the power to issue an injunction on the sales while the U.S. Court of Appeals discusses whether or not the Galaxy Tab 10.1 infringes on Apple's patents. If the Court of Appeals does find that the tablet infringes on Apple's technology then Koh will have the power to issue an injunction, Bloomberg explained Tuesday. However, the Appeals Court did say that Apple has the right to attempt to block sales of the tablet while it's working on its decision. "The appeals court disagreed with Koh's finding that Apple failed to show it was likely to win its case on the merits, according to court filings," Bloomberg said. This is the second time Koh has denied Apple's request for a ban. Apple has filed similar requests around the globe and managed to ban local subsidiaries from selling the original Galaxy Tab 10.1 in Australia and Germany.
