As part of the ongoing court battle between Apple and Samsung, Samsung’s lawyers want to see the iPhone 4S/iPhone 5 and the next generation of the iPad. The company claims that the Droid Charge and Galaxy Tab 10.1 will be in the market at the same time as the next iPhone and iPad, and that it needs to see the new devices to determine if there are any similarities between the devices they might need to sue Apple for.

The request is part of an existing lawsuit between the two companies. Apple made a similar request last week, asking to see the Galaxy Tab 10.1, 8.9, Galaxy S II, Infuse 4G, and Droid Charge. The court sided with Apple on that front, but all of those devices have been reviewed and photographed – we all know they exist. iPad 3 and iPhone 4S/5? Not so much.

Only Apple’s lawyers (not Apple ) will be able to check out Samsung’s devices when it forks them over. If Samsung was to win the same privilege, presumably only its lawyers would be able to see the newest iPad and iPhone.
