Apple vs. Samsung - Argument - Lawsuit - Fight - 004

The Justice Department will investigate Samsung's use of wireless patents, according to a report from Dow Jones Newswires on Wednesday that cites Apple as the source. Apple has been pushing into an investigation of how Samsung uses its patents and has argued that several of them are "essential to wireless technology standards," Dow Jones said. If the patents are indeed essential to wireless technology, as Apple agrees, then Samsung should license them fairly. A similar investigation is being carried out by the European Commission.

"Allowing Samsung to revenge on its FRAND commitments through the issuance of an exclusion order would have consequences extending beyond this case, and the harm to public interest would be severe," Apple argued in a document filed with the ITC.

A jury reached a verdict in the case of Apple v. Samsung earlier this year in which it found that the South Korea-based phone maker owes Apple more than $1 billion in damages.
