Samsung recently said that it will add the iPhone 5 to its existing patent lawsuits against Apple. “Samsung anticipates that it will file, in the near future, a motion to amend its infringement contentions to add the iPhone 5 as an accused product,” Samsung said in a court filing spotted by Reuters on Thursday. “Based on the information currently available, Samsung expects that the iPhone 5 will infringe the asserted Samsung patents-in-suit in the same way as the other accused iPhone models.”
Samsung also said that it has “little choice” but to go after Apple, which it says is continuing to take “aggressive legal measures that will limit market competition.” Samsung’s decision to add the iPhone 5 to its patent lawsuit could lead to a preliminary injunction against sales of the iPhone 5, Reuters said.
Apple won the most recent U.S. court battle in late August when a jury ruled in favor of the iPhone maker. Samsung, as a result, is required to pay more than $1 billion.
