Hasbro Loses in Court, Sales of Asus Transformer Prime to Continue

Hasbro’s suit against Asus’ Transformer Prime tablet has been dismissed. The toymaker filed a lawsuit against Asus late last year alleging the Tegra 3 tablet would confuse consumers into believing the device was produced by Hasbro. But Hasbro failed to convince the court, and the judge ruled that “there is nothing gimmicky about the Eee Pad Transformer or the Eee Pad Transformer Prime.” Asus’ case was also apparently strengthened by the fact that using the word “transformer” accurately described its tablet line since they have the ability to “transform into a laptop computer when attached to its accompanying QWERTY keyboard dock.” Worth noting: Neither the judge or Asus disputed Hasbro’s claim to the Transformers and Transformers Prime pending trademarks. The judge’s ruling merely means the toymaker failed to prove consumers would be confused between its line of toys and Asus’ tablets.
